Order on Motion to Compel
ORDER. The Court held a Discovery Conference in this matter. Plaintiffs Eric Meyer and The Hoch Publishing Co., Inc. ("Plaintiffs") appeared through counsel Bernard Rhodes and Emma Halling. Defendants City of Marion, Kansas, David Mayfield, Gideon Cody, and Zach Hudlin ("City Defendants") appeared through counsel Jennifer Hill and Scott Ufford. During the conference, the City Defendants raised an oral motion to compel. Having reviewed the joint position statement of the parties, the discovery responses at issue, the parties' conferral correspondence, the relevant Federal Rules of Civil Procedure and caselaw, and having heard the argument of counsel, the Court grants 141 City Defendants' Oral Motion to Compel Plaintiffs Eric Meyer and The Hoch Publishing Co., Inc. and entered the following orders. Plaintiffs shall supplement their responses to the City Defendants' First and Second Requests for Production of Documents identifying by Bates number documents which are responsive to each request no later than 10/29/2026 and certify same to the Court. The Court finds the parties have conferred as required by local rule regarding the requests for production at issue. After discussion regarding the scope of communications between Eric Meyer and third parties sought and narrowing the scope as discussed, the Court overrules Plaintiff Eric Meyer's objections regarding over breadth to Request for Production No. 43. The Court additionally overrules Mr. Meyer's objections regarding undue burden and proportionality to same. Regarding the temporal scope for Request for Production No. 29(k) to The Hoch Publishing Co., Inc., after discussion the parties agreed to use the same temporal scope as for Request for Production No. 43 to Mr. Meyer. With that agreement, the Court overruled Plaintiff's objections regarding over breadth, undue burden, and proportionality to Request for Production No. 29(k). The parties shall confer regarding appropriate search terms for both requests no later than 10/22/2026. Order on Motion for Discovery
ORDER granting 138 Joint Motion to Extend Discovery Deadline. After discussion, the Court extends the close of discovery up to and including 1/29/2027. The parties shall confer and submit an agreed plan with deadlines for filing dispositive motions in the two remaining member cases to the undersigned's chambers by 10/28/2026. Orders with the separate deadlines for the submission of proposed Pretrial Orders and setting the Pretrial Conferences will be entered in the appropriate member case. IT IS SO ORDERED.
