The Court DENIES Plaintiffs' motion for summary judgment against Defendant Kyle Thomas. Defendant Thomas's 62 Renewed Motion for Summary Judgment is GRANTED IN PART and DENIED IN PART. The Court GRANTS summary judgment in favor of Defendant Thomas on Plaintiffs' breach-of-contract claims (Count I). The Court DENIES summary judgment on Plaintiffs' fraud claim as to Plaintiff Tyson Mehlhoff, but GRANTS summary judgment on Plaintiffs' fraud claims as to Plaintiffs Tyacke, Lyons, Hatch, Blackwood, Jaxon Mehlhoff, Trent Mehlhoff, and Jason Newby (Count II). Also, the Court GRANTS summary judgment in favor of Defendant Thomas on Plaintiffs' fraud claim as to Plaintiff Bregman (Count III). Plaintiffs' 74 Motion to Strike Defendant Thomas's reply in support of his statement of material facts is GRANTED as unopposed.
