OPINION AND ORDER re: 189 MOTION to Dismiss Plaintiff's Complaint. filed by Cerovene Inc., 179 MOTION to Dismiss . filed by Safety-Kleen Systems, Inc., Clean Harbors, Inc..For the reasons outlined above, Moving D efendants' motion to dismiss is DENIED. To be clear, while Plaintiff has plausibly alleged claims for relief as indicated, the Court is mindful that Plaintiff will now have to establish, by admissible proof, the evidence to sustain these claims, or any of them. Plaintiff's request for "leave to amend," made improperly in its opposition, is denied as unnecessary in light of the Court's rulings herein. Moving Defendants are directed to file Answers to the TAC within 14 days of the issuance of this Opinion & Order.
