ORDER DENYING WITHOUT PREJUDICE MOTION FOR ALTERNATIVE SERVICE: For the foregoing reasons, "we find it prudent to require that a formal effort to serve defendant [under the Hague Convention] be made in the first instance, thereby ensuring that all interested parties are provided notice of the suit." Devi, 2012 WL 309605 at *2 (citation modified) (denying motion for alternative service pursuant to Rule 4(f)(3) where plaintiffs did not make service attempts under the Hague Convention ). Accordingly, because the Court does not find that Plaintiffs have made out a requisite showing that they have reasonably attempted to effectuate service on Thorbjornsen, the pending motion is DENIED without prejudice to renewal.
