ORDER GRANTING AS UNOPPOSED 41 Motion to Hold Case in Abeyance as to Federal Respondents. On July 28, 2026, Federal Respondents moved to hold Petitioner's motion for attorney's fees under the Equal Access to Justice Act (EAJA) in abeyance until sixty days after the Supreme Court decides Montoya Palacios v. Liggins, No. 25-1223, which is currently pending before it. The question presented in Montoya Palacios is whether immigration habeas petitioners are entitled to EAJA fees, and the Supreme Court's decision will thus directly bear on Petitioners motion for EAJA fees. Petitioner does not oppose Federal Respondents' motion. The court therefore GRANTS the motion and STAYS Petitioner's motion for EAJA fees, (Doc. 39), until Montoya Palacios has been decided.
