Bankruptcy Appeal (801) | New York Eastern
Scheduling Order
ORDER: The Court is in receipt of Appellee Huebscher's 18 Letter and the Parties' 20 Proposed Scheduling Order and Consolidated Bankruptcy Record. The Court adopts the Parties' proposed briefing schedule as follows: Appellant's opening brief shall be filed on August 11, 2026. Appellee's responsive brief shall be filed on September 10, 2026. Appellant's reply brief shall be filed on September 24, 2026.
The Court adopts the Parties' proposed consolidated bankruptcy record. Because this record differs from the one previously filed, (Dkt. 17), The parties shall file this consolidated record by July 9, 2026.
Finally, in light of Emilio Noseda's withdrawal from the transaction, (see Dkt. 18), the Court directs the Parties to file a stipulation dismissing Noseda as a party to the action. The Court also expects the Parties to address this factual development in their briefing. Ordered by Judge Pamela K. Chen on 7/2/2026. (ABB)
