ORDER re 263 MOTION for Preliminary Injunction filed by Christopher Reh. Christopher Reh has filed a Motion for Preliminary Injunction through which he seeks to enforce the Consent Decree entered in this matter. The Court construes the motion as a Motion for Compliance. However, it is not clear that his motion alleges any actual violation of the Consent Decree, which, as this Court has previously observed, "sets forth several policies and procedures designed to ensure that PSRB patients are treated on an individualized basis and in a manner that is least restrictive on their freedom." ECF No. 261 . "The Decree does not address substantive psychiatric treatment for PSRB patients. Instead, it provides procedural safeguards to protect PSRB patients from arbitrary decision-making and to ensure that PSRB patients are being treated on an individualized basis. Id. Mr. Reh alleges that he is not receiving appropriate medical care, specifically a consultation with a nephrologist, and he seeks an order that he be provided a therapist who is unaffiliated with the Department of Mental Health and Addiction Services. He also appears to assert claims wholly unrelated to the protections afforded under the Consent Decree. Accordingly, Defendants shall file a response to the Motion, as construed, on or before September 18, 2026. Mr. Reh may file a reply to the Defendant's response on or before October 2, 2026.
