Order on Motion for Extension of Time to Complete Discovery
ORDER granting 83 Motion for Extension of Time to Complete Discovery. The parties jointly request an extension of the discovery deadlines because: (1) there are unresolved discovery issues; (2) the parties are awaiting the report from BODE Technology about the DNA comparison, which is anticipated in October or November 2026; and (3) pertinent medical issues have further delayed fact discovery. See ECF No. 83 at 1. Good cause appearing, the proposed order at ECF No. 83-1 is so ordered. A joint status letter is due to the Court on or before December 14, 2026. Fact discovery closes December 29, 2026. By the same date, the parties must file a joint letter certifying the close of fact discovery.
The parties are urged to make their best efforts to have the BODE Technology report prepared promptly. Given the age of the case and the several extensions that have been granted, counsel are reminded that any further extension requests must show due diligence and good cause. The parties are to serve a discovery status letter by October 16, 2026, outlining any remaining discovery disputes.
