(In Chambers) Order by Judge Stanley Blumenfeld, Jr.: On September 8, 2026, Plaintiff filed a motion to dismiss Defendants' counterclaims. Dkt. No. 33. Shortly thereafter, the Court issued its order on Defendants' motion to dismiss. Dkt. No. 34. The Court's order adjudicates some of the same issues now raised in Plaintiff's motion. To avoid unnecessary delay and waste of resources, Plaintiff's motion to dismiss is denied without prejudice, and the parties are ordered to meet and confer in person or by videoconference to attempt in good faith to resolve or narrow their remaining disputes in light of the Court's order. If Defendants believe they can improve their counterclaims or that any of them should be dropped in light of the Court's ruling, they shall file second amended counterclaims no later than September 18, 2026, and Plaintiff shall answer or otherwise respond no later than October 2, 2026. Otherwise, if Defendants wish to stand on their counterclaims and will not seek leave to amend if any of them are dismissed, Plaintiff may file a renewed motion to dismiss or answer no later than September 18, 2026. The parties shall also meet and confer about the scope of Defendants' jury demand, and Defendants shall make clear, either in their second amended counterclaims or in a status report filed no later than September 18, the claims on which they demand a jury trial.
