ORDER granting 12 : The parties report having reached a settlement in principle. Accordingly, the 05/09/2024 initial conference and related deadline to submit a joint proposed discovery order is adjourned sine die. By 06/10/2024, the parties shall file their motion for settlement agreement pursuant to Cheeks v. Freeport Pancake House, Inc., 796 F.3d 199 (2d Cir. 2015). The Cheeks motion shall include (1) a fully executed copy of the proposed settlement agreement, and any translated copies of the agreement, if applicable; (2) a letter brief (of seven pages or fewer) that includes a fulsome analysis of the factors set forth in Wolinsky v. Scholastic Inc. , 900 F. Supp. 2d 332, 335-36 (S.D.N.Y. 2012), and related cases; (3) an explanation of and documents related to Plaintiff's damages calculations; and (4) if attorneys' fees and costs are included in the settlement, time and billing records and receipts for Plaintiff's counsel and copies of any relevant retainer agreements, if applicable.
Pursuant to EDNY Administrative Order 2023-23, the parties may consent to the undersigned as the presiding judge in this action no later than 30 days following this Order, or by 06/03/2024. (See ECF No. 2 ; see also Notice of Option to Consent to Magistrate Judge Jurisdiction (available at https://img.nyed.uscourts.gov/files/forms/MJConsentForm.pdf). If the parties do not consent by that date, a United States District Judge will be randomly assigned as the presiding judge, and the undersigned will remain as the assigned Magistrate Judge. The parties may also consent to the undersigned's jurisdiction after a United States District Judge is assigned. The parties are free to withhold consent without adverse substantive consequences.
