See In re Mersho, 6 F.4th 891, 897 (9th Cir. 2021) (To determine whether a writ of mandamus should be granted, we weigh the five factors outlined in Bauman v. United States District Court.); Bauman v. U.S. Dist. Court, 557 F.2d 650 (9th Cir. 1977). Accordingly, the petition for a writ of mandamus is denied. Petitioner's motion to proceed in forma pauperis (Docket Entry No. 4) is denied as moot. No further filings will be entertained in this closed case. DENIED. (RE)

The district court certified that this appeal is not taken in good faith and denied appellant leave to proceed on appeal in forma pauperis. See 28 U.S.C. § 1915(a). On February 13, 2024 the court ordered appellant to explain in writing why this appeal should not be dismissed as frivolous. See 28 U.S.C. § 1915(e)(2) (court may dismiss case at any time, if court determines it is frivolous or malicious).The motion to extend time to file a response to the February 13, 2024 order is granted. Upon a review of the record and responses to the court's February 13, 2024 order, we conclude this appeal is frivolous. We therefore deny appellant's motion to proceed in forma pauperis and dismiss this appeal as frivolous, pursuant to 28 U.S.C. § 1915(e)(2). No further filings will be entertained in this closed case. DISMISSED. (le)
