Merrill Dow Pharmaceuticals, Inc., 509 U.S. 579 (1993) line of cases shall file on or before September 23, 2026, a pre-motion letter that complies with Section IV.A of the Court's Individual Practices, including the requirement that any such letter related to a motion for summary judgment must be accompanied by a statement of material facts that complies with Local Civil Rule 56.1. There shall be no cross-motions. Any party opposing the motion(s) shall file a responsive letter and, if applicable, a responsive statement that complies with Local Civil Rule 56.1, on or before October 14, 2026. If no party moves for summary judgment or to exclude expert testimony, the parties shall file a jointly proposed pretrial order that complies with Section VI.B of the Court's Individual Practices on or before October 21, 2026.
