ORDER TO SHOW CAUSE -- Plaintiff moved for default judgment on April 10, 2026. The Court has identified deficiencies with Plaintiff's filings.
Plaintiff has not submitted a proposed order as required by Rule 55.2(a)(2) of the Local Civil Rules. In addition, Plaintiff's affidavit does not show that "the party seeking default judgment has complied with the Servicemembers Relief Act, 50a U.S.C. § 521; and [that] the party against whom judgment is sought is not known to be a minor or an incompetent person." (See Local Civil Rule 55.2(a)(1).)
Courts in this Circuit regularly deny motions for default judgment for failure to strictly comply with Rule 55.2's procedural requirements. Santacruz v. Blok Chocolatier LLC, No. 19 CV 544, 2021 WL 4341103, at *2 (E.D.N.Y. June 23, 2021), report and recommendation adopted by, 2021 WL 4340963, at *1 (E.D.N.Y. Sept. 23, 2021); United States v. Hamilton, No. 18 CV 2011, 2019 WL 6830318, at *3 (E.D.N.Y. Nov. 26, 2019) (collecting cases), report and recommendation adopted by, 2019 WL 6828276, at *1 (E.D.N.Y. Dec. 13, 2019).
Plaintiff is directed to supplement the record by October 29, 2026 in order to have the Motion for Default Judgment considered.
