Initial Conference Hearing ~Util - Set Deadlines/Hearings
Minute Entry for proceedings held before Magistrate Judge Joseph A. Marutollo: An initial conference was held on the record on May 7, 2024. All counsel appeared.
The parties' proposed Discovery Plan and Scheduling Order was discussed. Following that discussion, the Court sets the deadlines below.
The date for completion of automatic disclosures required by Fed. R. Civ. P. 26(a)(1) shall be May 27, 2024.
No amendment of the pleadings will be permitted after July 8, 2024.
No additional parties may be joined after July 8, 2024.
Fact discovery shall be completed by November 27, 2024.
Plaintiff shall make required Fed. R. Civ. P. 26(a)(2) disclosures, if any, by December 6, 2024.
Defendant shall make required Fed. R. Civ. P. 26(a)(2) disclosures, if any, by January 10, 2025.
All discovery, including expert discovery, shall be completed by February 7, 2025.
The final date to take the first step in dispositive motion practice, if any, shall be March 7, 2025.
An in-person settlement conference is scheduled for July 24, 2024 at 11:00 a.m. in Courtroom 324 North before Magistrate Judge Joseph A. Marutollo.
The parties shall submit ex parte settlement letters to Judge Marutollo's chambers via email (marutollo_chambers@nyed.uscourts.gov) by July 17, 2024 at 5:00 p.m. The ex parte settlement letters shall comply with Rule III.C of Judge Marutollo's Individual Practices and Rules. Client representatives with settlement authority shall appear, in person, at the settlement conference.
The parties are to submit a joint status report by June 21, 2024 outlining the current status of discovery.
No extension of the above deadlines will be granted except upon a motion, filed prior to the deadline and consistent with Judge Marutollo's Individual Practices and Rules, showing good cause for the extension. The parties are reminded that "a finding of 'good cause' depends on the diligence of the moving party." Parker v. Columbia Pictures Industries, 204 F.3d 326, 340 (2d Cir. 2000). (ZoomGov #2:35-2:51.)
