ORDER denying 139 MOTION for Leave to Appeal in forma pauperis Notice of Appeal -- In the Court's September 1, 2026 Memorandum & Order, the Court certified pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from the September 1, 2026 Memorandum & Order would not be taken in good faith and therefore denied in forma pauperis status for the purpose of an appeal. See ECF No. 135 at 12-13 (citing Coppedge v. United States, 369 U.S. 438, 444-45 (1962)); see also Judgment, ECF No. 136. On September 2, 2026, pro se Plaintiff filed a Notice of Appeal, see ECF No. 138, and a Motion for Leave to Appeal in forma pauperis, see ECF No. 139. As set forth in the September 1, 2026 Memorandum & Order, any appeal from the September 1, 2026 Memorandum & Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal. Plaintiff's Motion for Leave to Appeal in forma pauperis, ECF No. 139, is DENIED. Ordered by Judge Diane Gujarati on 9/8/2026. (KEP)
