Minute Order Order on Stipulation ~Util - Terminate Deadlines/Hearings
MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey on 8/17/2026.
The parties have stipulated to continue the presently scheduled trial date of 11/3/26 until April 2027 because the plaintiff is continuing to receive medical treatment and additional discovery, including depositions, will be needed. Based upon the representation that the plaintiff is continuing to receive ongoing treatment that makes a November 2026 trial date difficult, the court VACATES the trial date and all related trial deadlines.
However, due to the uncertainty of the end of the treatment and the fact that the parties apparently seek to reopen discovery to permit additional depositions, it would be premature to schedule the trial date yet. Additionally, the scope of, and schedule for, additional discovery is a matter separate from the trial date and which needs to be decided by the magistrate judge on an appropriate motion to reopen discovery. IT IS THEREFORE ORDERED that the stipulation 55 is DENIED, but the trial currently set for 11/3/26 and all related trial deadlines ARE VACATED. The parties must file an appropriate joint motion to reopen discovery and amend the scheduling order before the magistrate judge. In the event that the magistrate judge grants that motion, the new proposed joint pretrial order will be due 30 days after the close of discovery (unless timely dispositive motions are filed, in which case the proposed joint pretrial order will be due 30 days after the resolution of the dispositive motions).
IT IS FURTHER ORDERED that the Zoom status conference scheduled for tomorrow, 8/18/26 at 3:30 p.m. is VACATED.
