FINAL ORDER - This matter comes before the Court on two motions: (1) a motion to dismiss for lack of standing, or in the alternative, a motion for summary judgment filed by the defendant, Atlantic Union Bank, (ECF No. 34 ), and (2) a motion to certify a class filed by the plaintiff, Brian Ray, (ECF No. 36 ). For the reasons stated in the accompanying opinion, the Court DENIES the Bank's motion to dismiss, (ECF No. 34 ); DENIES Ray's motion to certify a class, (ECF No. 26 ); and GRANTS the Banks motion for summary judgment, (ECF No. 36 ).
