As stated on the record, Plaintiff's Motion for Leave to File (ECF No. 32 ) was granted, and the Defendant's Emergency Motion to Vacate and Stay (ECF No. 34 ) was denied. The Court made preliminary remarks, and counsel made representations regarding the Plaintiff's Motion for Temporary Restraining Order (ECF No. 5).
The Court recessed from 2:52 p.m. to 3:05 p.m.
Mr. Tabor stated that the Plaintiff would withdraw its motion for a temporary restraining order (ECF No. 5 ), and Mr. Kappelman indicated that he had no objection. The Court therefore deemed the motion withdrawn.
