MINUTES (IN CHAMBERS) ORDER GRANTING IN SUBSTANTIAL PART PLAINTIFF'S MOTION TO COMPEL PRODUCTION OF DOCUMENTS BY DEFENDANT [ECF 33 ] by Magistrate Judge Steve Kim. For all these reasons, Mt. Hawley's motion to compel (ECF 33 ) is GRANTED IN PART AND DENIED IN PART: 1. As to documents withheld (accurately on the privilege log) based on claimed attorney-client privilege or attorney work-product protection, the motion is GRANTED. Wesco shall produce these documents by no later than August 10, 2026, the same deadline for its answer. See L.R. 72-2.2. As to documents also withheld on a distinct ground of mediation-communication privilege, the motion is DENIED WITHOUT PREJUDICE. The parties shall meet and confer, though, to determine whether the privilege log is accurate as to this asserted classification; if so, whether the privilege has been correctly asserted under the law; and, even if so, whether the privilege has been waived.
