Order Reopening Case
TEXT ORDER: This matter comes before the Court upon its previous Order regarding Plaintiffs' Motion to Dismiss. (ECF No. 308 .) Per that Order, the Court gave Defendants Eva Chin ("Chin"), Norman Remedios ("Remedios"), and the Entity Defendants 734 N Sawyer G LLC, 201-203 E 9th G LLC, 195 N 16th EC LLC, 343-345 E 3rd G, LLC, 139 Washington G LLC, 69 South 9th G LLC, 540 S Clinton G LLC, and 273 Liberty Ave G LLC (the "Entity Defendants") until June 8, 2026, to submit their opposition to Plaintiffs' Motion pursuant to Federal Rule of Civil Procedure 41(a)(2). (Id.; ECF No. 307 .) The Court is satisfied that these various Defendants have received ample notice to contest Plaintiffs' voluntary dismissal. Defendants Chin and Remedios received the Court's previous Order--and all other case filings--from the Court electronically. (Notice of Electronic Filing Details to ECF No. 308.) As to the Entity Defendants, in contravention of Local Civil Rule 10.1(a), these Defendants failed to provide their business address with their answer and have never provided the Court with a proper mailing address. (ECF No. 103 ; see also ECF Nos. 150 - 151 (attempting unsuccessfully to send mail to the Entity Defendants).) After the withdrawal of their counsel (which was mailed to them by departing counsel via first class and certified mail), the Entity Defendants never retained new counsel or provided the Court with updated addresses, as required by local rule. (ECF Nos. 138 , 302 ); L. Civ. R. 10.1(a). Thus, consistent with the Court's previous Order, Plaintiffs' Motion will be treated as unopposed for failure to respond in the time allotted. Accordingly, Plaintiffs' Motion is GRANTED. All remaining claims against (and all remaining cross- and counterclaims brought by) the above Defendants are DISMISSED WITHOUT PREJUDICE under Rule 41(a)(2). The Clerk is directed to temporarily RE-OPEN this matter for the sole purpose of CLOSING it. The Clerk is also ordered to CLOSE the motion pending at ECF No. 307 .
