MINUTE entry before the Honorable Keri L. Holleb Hotaling: Based on Defendants' supplement [Dkt. 116] to their motion for Rule to Show Cause against Michael Evans [Dkt. 101], it does not appear Mr. Evans is deliberately avoiding the deposition subpoena and Rule to Show Cause notices served upon him in this matter, but that he is medically unable to participate in a deposition at this time. The Court cannot and will not generally let the Rule to Show cause stand until such time as Mr. Evans becomes medically well enough, if he ever does, to sit for a deposition in this matter. Therefore, the Rule to Show Cause [Dkt. 101] is hereby DISCHARGED. However, if the parties later become aware that he becomes medically well enough to sit for a deposition, the Court would certainly consider reopening fact discovery for the limited purpose of deposing Mr. Evans. The Court is to make Mr. Evans aware of the fact that the Rule to Show cause against him is discharged and he does not need to appear at the 8/18/2026 court hearing. The Court hereby strikes the 8/18/2026 motion hearing on the continued Rule to Show Cause hearing and resets the matter for a telephonic status hearing on 8/18/2026 at 9:30 a.m. (NOTE: SAME DATE, SAME TIME.) The call in information is 855-244-8681, and the participant access code is 2315 0911 461#. Members of the public and media will be able to call in to listen to this hearing but will be placed on mute. Persons granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting of court proceedings. Violation of these prohibitions may result in sanctions, including removal of court issued media credentials, restricted entry to future hearings, denial of entry to future hearings, or any other sanctions deemed necessary by the Court. Additionally, persons are to place their devices on mute when they are not speaking. Any motions the parties wish to be heard at the status must be filed by 8/11/2026.
