Re: 69 Stipulation to Take the Deposition of Jason Garber, MD Outside the Close of Discovery.
The Court DENIES the parties' stipulation for two reasons.
First, the parties' request is really one to extend the discovery deadline for the limited purpose of taking Jason Garber, MD's deposition. But the parties do not cite Local Rule 26-3 for their request. As a result, the parties do not explain why they require the extension they seek as required by the rule. So, the Court is unable to evaluate the propriety of their request.
Second, the deposition that the parties stipulate to take is one that Defendant has moved the Court for leave to take. Compare (ECF No. 68 at 6) (seeking the Court's leave to depose Jason Garber, MD) with (ECF No. ECF No. 69 ) (stipulating regarding the deposition of Jason Garber, MD). While the Court has denied the motion for leave to exceed the ten-deposition limit in which Defendant sought leave to depose Dr. Garber, given the unexplained inconsistency between the instant stipulation and the prior motion, the Court declines to grant the stipulation.
