ENDORSEMENT: The Court is in receipt of Defendants' request to extend the fact discovery deadline in this action (Dkt. No. 71), and Plaintiff's opposition thereto (Dkt. No. 72). As Plaintiff writes that it anticipates production of the relevant text messages prior to the scheduled depositions' the earliest of which appears to be set for August 12, the Court denies Defendants' extension request without prejudice. However, Defendants may renew this request on Monday, August 10, 2026, should production of the text messages and other ESI material not have occurred prior to that date and/or prove so substantial that proper evaluation cannot be completed prior to the first depositions.
