Stipulation and Order
JOINT DISBURSAL STIPULATION AND ORDER FOR WITHDRAWAL OF FUNDS FROM INTEREST BEARING ACCOUNT: Accordingly, IT IS STIPULATED AND AGREED as follows: 1. Plaintiff and Garnishee hereby agree that this stipulation shall constitute a Joint Disbursal Stipulation as described in the Garnishment Order and as referred to in Paragraph C(3) above. 2. Plaintiff and Garnishee hereby jointly request that the Available Funds- that is, the Attached Funds in the amount of $553,309.90, plus all accumulated interest thereon, less any authorized fees- be withdrawn from the Court Registry Investment System and paid via electronic means to Garnishee, who will provide the Clerk of Court with a completed form AO-213P and IRS form W-9. 3. Plaintiff will take any additional steps required of Plaintiff by the Court or the Clerk of the Court to effect release of the Available Funds to Garnishee. 4. Plaintiff and Garnishee have entered into a separate stipulation of dismissal, by which they have agreed to the dismissal with prejudice of the instant Action ("Dismissal Stipulation"), which will be filed by Garnishee upon its receipt of the Available Funds. 5. This Stipulation may be executed in facsimile and/or electronically scanned counterparts and may be filed without further notice with the Clerk of Court. SO ORDERED. (Signed by Judge Louis L.
