FINDINGS AND RECOMMENDATION: For the reasons stated, the Court recommends that the district judge GRANT IN PART and DENY IN PART AuguStar's Motion to Dismiss (ECF No. 9 ), DISMISS Plaintiffs' negligence and elder abuse claims with leave to amend within fourteen days, and allow Plaintiffs' breach of contract and breach of the covenant of good faith and fair dealing claims to proceed.
