Order on Motion to Withdraw as Attorney Scheduling Order
ORDER. As discussed during the conference, given the dispositive nature of the pending motion practice at ECF No. 20 , a District Judge has been assigned to this action.
Defendant Sam Andino, representative of the corporate Defendant, confirmed on the record that he does not oppose his attorney's motion to withdraw at ECF No 19 , which is granted. Attorney Stanislav Swarovski must timely transfer all files related to this action to his former client. Attorney Stanislav Swarovski is terminated as counsel in this action. The Court advised Mr. Andino that it is possible, though unlikely, that a volunteer attorney may be available and may choose to represent his business. The Court will send him the appropriate form through which to do so. Mr. Andino expressed that his business may declare bankruptcy; the Court advised Mr. Andino that if he does so, he must inform the Court immediately, as a bankruptcy proceeding may result in an automatic stay of this action. On or before 8/14/2026, Mr. Andino's new attorney must appear in this action by answering or filing a motion to dismiss. Alternatively, Mr. Andino may file a letter informing the Court of his progress in hiring an attorney, his settlement discussions with Plaintiff, and his status as to bankruptcy.
With the assistance of Plaintiff, Defendant Jordan Vassal filed a motion to dismiss at ECF No. 20 . To clarify the entry, the Court has amended the motion at ECF No. 20 to name Mr. Vassal as the moving party. Plaintiff must respond to the motion by 7/17/2026, but this schedule may be altered once a District Judge has been assigned. The parties should carefully examine the Individual Rules of the District Judge, which may affect the form and schedule of the motion practice. After the schedule has been set, the undersigned will address the issue of discovery.
