MINUTES of Proceedings: Oral argument held before Judge Karin J. Immergut on October 1, 2026. For the reasons stated on the record, upon review of Defendants' Motion to Decertify the Class, ECF 172 , and the parties' related briefing, this Court finds that Plaintiffs have demonstrated the class continues to meet each requirement for class certification established by Fed. R. Civ. P. 23(a) (numerosity, commonality, typicality, and adequacy) and Fed. R. Civ. P. 23(b)(3) (predominance and superiority). Therefore, Defendants' Motion to Decertify the Class, ECF 172 is DENIED, and the case will proceed as a bifurcated class action with liability and damages phases as outlined in this Court's previous order bifurcating the trial, ECF 71 . Additionally, this Court GRANTS Defendants' Motion to Set the Time for Rebuttal Expert Reports, ECF 185 . Rebuttal expert disclosures are due October 29, 2026. There are no further modifications to this Court's previous scheduling order, ECF 167 . Nadia H. Dahab, Jessica Greenlick Snyder, and Joseph E. Piucci present as counsel for plaintiff(s).
