The Court DECLARES that Plaintiff is the current interest owner of the promissory note secured by the deed of trust recorded on October 3, 2022 as Instrument No. 2022-1443338 in the Official Records of Clallam County, Washington.The Court DECLARES that as of its original recording date of October 3, 2022, the deed of trust is a valid and enforceable first in priority lien which continued and continues to encumber the property located at 1525 W 7th St., Port Angeles, Washington 98363, assigned Assessors Parcel Number 06300 015170, and legally described as follows: LOT 14, BLOCK 151, TOWNSITE OF PORT ANGELES, CLALLAM COUNTY, WASHINGTON. The deed of trust is senior to any interest held by the Defendants, and each of them, or any subsequent lienholder, encumbrancer, or creditor, who purports to take from the Defendants and each of them after as of October 3, 2022. The Court DECLARES that Defendants are in monetary default under the terms and obligations of the Note and Deed of Trust. Because the Court has dismissed Plaintiffs fraud claim without prejudice (see Dkt. 26), Plaintiffs remaining requests for declaratory relief are DENIED.Signed by District Judge Tiffany M. Cartwright.
