MINUTE entry before the Honorable Sunil R. Harjani: For the reasons stated in the Memorandum Opinion and Order entered today, Butterball's motion for summary judgment 1560 , JOTS' motion for summary judgment 1533 , and Prestage's motion for summary judgment 1551 are granted in part and denied in part, and Foster's motion 1556 and Perdue's motion 1586 for summary judgment are granted. Starting October 8, 2026, the DPPs will proceed to a jury trial on the per se claims against the Butterball, JOTS, and Prestage entities that have survived summary judgment. The CIIPPs and remaining DAPs will separately proceed to a jury trial on their per se claims against the Butterball, JOTS, and Prestage entities (and potentially other defendants) at a later date. The DPPs, Butterball, JOTS, and Prestage are ordered to meet and confer via videoconference about settlement and to discuss whether reengaging with settlement talks with the assistance of the Magistrate Judge would be of assistance. By July 21, 2026, the DPPs, Butterball, JOTS, and Prestage shall inform Magistrate Judge Holleb Hotaling on the outcome of the meet and confer. To the extent the Memorandum Opinion and Order entered today moots any portion of the Daubert motions currently pending before the Court, the parties shall indicate what portions of the arguments no longer need to be addressed in their Daubert reply briefs.
