STIPULATION OF DISMISSAL WITHOUT PREJUDICE: Plaintiffs Zurich American Insurance Company ("ZAIC") and American Zurich Insurance Company ("AZIC") hereby dismiss, without prejudice to recommencement, all claims and causes of actions asserted in this action. Defendant XL Insurance America, Inc. ("XL") hereby dismisses, without prejudice to recommencement, all counterclaims and causes of actions asserted in this action. Dismissal of all claims, counterclaims and causes of actions is without imposition of costs upon any party. The Stipulation of Dismissal Without Prejudice is executed without waiver of any rights possessed now or in the future by ZAIC, AZIC and/or XL.
