STIPULATION AND ORDER FOR PARTIAL DISMISSAL: Plaintiff Honeywell International Inc. ("Honeywell") hereby dismisses with prejudice its Complaint, ECF No. 1 , and each and every count and claim asserted therein, against Defendants Buckeye Partners, L.P., Buckeye GP, LLC, and Buckeye Pipe Line Company, L.P. (collectively "Buckeye"). For the avoidance of doubt, Honeywell through this stipulation is not dismissing the actions, or any counts or claims asserted therein, in the consolidated cases Honeywell International Inc. v. Sunoco (R&M), LLC, et al., No. 5:18-CV-01176 (FJS/ML) or Honeywell International Inc. v. CITGO Petroleum Corporation, No. 5:19-CV-01219 (FJS/ML) (collectively, "Consolidated Cases"). Buckeye hereby dismisses with prejudice its Amended Third-Party Complaint ("Second Third-Party Complaint"), ECF No. 108 , and each and every count and claim asserted therein, against Third-Party Defendants: Atlantic Richfield Company; CITGO Petroleum Corporation; Chevron Corporation; Chevron U.S.A. Inc.; Exxon Mobil Corporation; ExxonMobil Oil Corporation (collectively, with, Exxon Mobil Corporation, ExxonMobil); Hess Corporation; Shell Oil Company; Sunoco (R&M), LLC (n/k/a Energy Transfer (R&M), LLC); Sun Pipe Line Company, LLC; Texaco, Inc.; and TRMI-H LLC (collectively, "Third-Party Defendants"). Third-Party Defendants hereby dismiss with prejudice each and every counter - and cross-claim asserted either against Buckeye and/or against one another. For the avoidance of doubt, Buckeye through this stipulation is not dismissing its First Third-Party Complaint against YAD Associates, Inc., Pyramid Company of Onondaga, Suzanne M. Congel and Douglas E. Ulrich, as Co-Executors of the Estate of Robert J. Congel, and Bruce A. Kenan ("YAD Defendants") (see ECF No. 38 ); nor are the YAD Defendants dismissing any claims they may have against Buckeye and/or ExxonMobil; nor is ExxonMobil dismissing any claims it may have against the YAD Defendants (see ECF No. 290 ); rather, Buckeye, the YAD Defendants, and ExxonMobil will seek to sever the remaining claims by and amongst them from the Consolidated Cases.
