Order on Discovery Plan
ENDORSED ORDER approving 12 Discovery Plan. Length of Trial 2-3 days. Case Track: Standard. PRETRIAL CONFERENCE CANCELLED. Text of Order: Approved and adopted as a pretrial scheduling order with the following modifications: Unless otherwise agreed by the parties or ordered by the court upon request, each party may serve the opposing party with a maximum of 25 requests for admission. Responses to any such requests shall be due within 30 days after service unless otherwise agreed pursuant to Fed. R. Civ. P. 29. By January 15, 2027, the parties shall file a joint report describing the status of fact discovery, including whether the parties remain on track to complete fact discovery by the March 15, 2027 deadline. The parties are advised that the court considers the deadline for the completion of discovery to be the deadline by which discovery is to be completed, not a deadline by which discovery is to be served. The parties shall notify the court, by April 2, 2027, whether mediation is appropriate and if so, whether they wish to pursue mediation pursuant to the courts mediation program. Any motions for summary judgment shall be filed by May 21, 2027. Trial: Trial shall take place during the two-week trial period beginning on October 19, 2027.
