SO ORDERED- re 49 Joint Motion for Teleconference to Resolve Discovery Dispute. IT IS HEREBY ORDERED that a Discovery Dispute Motion Hearing is set for May 20, 2024 at 2:00 PM before Judge Sherry R. Fallon. In preparation for this hearing the parties shall follow the Discovery Matters and Disputes procedure as set forth in the Order regarding discovery matters available at www.ded.uscourts.gov/judge/magistrate-judge-sherry-r-fallon. The proposed orders attached as exhibits to the moving submissions shall identify with specificity the relief being sought. For example, relief sought on the logistical aspects of source code production should be tied to specific paragraphs in the Delaware Default Standard for Access to Source Code. Relief sought on the scope of source code / core technical document productions should include clearly defined parameters on the requested scope of the production, consistent with the non-exhaustive definition of core technical documents at &para 4(b) of the Delaware Default Standard for Discovery and the Court's decision in Cirba Inc. v. VMWare, Inc., C.A. No. 19-742-LPS, 2021 WL 7209447 (D. Del. Dec. 14, 2021). The parties should obtain court reporting services for the conference, with the cost to be shared equally between both sides. No later than May 17, 2024 at 11:00 AM, the parties shall send a joint email to Larisha_Hicks@ded.uscourts.gov containing (i) the name of the court reporter; (ii) the name of the court reporting agency; and (iii) confirmation that the court reporter has been provided with the court's AT&T dial-in information. The Court may choose to resolve the disputes prior to the telephone conference and will, in that event, cancel the conference.
