ELECTRONIC ORDER: Pending before the Court is Defendant, Driveway Finance Corporation's Motion to Dismiss, or alternatively, unopposed Motion to Compel Arbitration. (Doc. 8 ). In the Motion's Certificate of Conference, Defendant represented that Plaintiff indicated that he is opposed to the Motion to Dismiss and, in the alternative, unopposed to the Motion to Compel Arbitration. However, Plaintiff failed to timely respond to the Motion.
