Order on Motion for Magistrate Judge
TEXT ORDER: The Court received the parties' joint letter, D.E. 117 , and Defendants' letter, D.E. 118 . Because of Defense counsel's current trial schedule, today's status conference is adjourned to November 4, 2026 at 12:30 p.m. Two days prior, the parties shall provide a joint status letter not to exceed 2 single-spaced pages on the status of discovery.
The joint letter shows that the parties are working cooperatively. Namely, the parties have confirmed that there is no overlap of putative class members relating to Morgan Stanley's bank deposit program ("BDP") in this action and in Sherlip v. Morgan Stanley, No. 24-cv-4571 (S.D.N.Y.) because "the Sherlip action does not seek to encompass E*TRADE from Morgan Stanley customer accounts enrolled in [Morgan Stanley's] BDP."
The parties also agree that Defendants will produce to Plaintiffs any emails or other documents relating to the Morgan Stanley BDP that are produced in Sherlip "to the extent they relate to the period of time after E*TRADE accounts were converted to E*TRADE from Morgan Stanley accounts enrolled in the Morgan Stanley BDP." Although the parties may disagree on when that period of time begins (i.e., the October 2023 conversion or some date before then), the parties agree to meet and confer in good faith before raising any disputes to the Court.
The parties otherwise will proceed with all written and document fact discovery. They do seek a limited stay of email review and production relating to the E*TRADE program while Defendants' anticipated motion to dismiss is pending. For now, the Court will temporarily stay such email review and production until the rescheduled status conference on November 4, 2026. At that conference, the parties should be prepared to argue why that interim stay should be extended past the conference.
Lastly, the Court will take under consideration the parties' briefing schedule and page-limit request for the anticipated Motions to Dismiss and will provide a response shortly. Signed by Magistrate Judge Alex D. Silagi on 9/24/2026. (arm)
