   ORDER terminating 45 Letter Motion for Leave to File Document; terminating 48 Letter Motion for Leave to File Document; granting 49 Letter Motion for Conference. The Court is in receipt of Mr. Ian Lagowitz's, the appointed receiver in this action (the Receiver), July 21, 2026 pre-motion letter seeking leave to move for approval of the Receiver's retention of Christopher A. Gorman and Rosenberg & Estis, P.C. as counsel to the Receiver. (ECF No. 45.) On July 22, 2026, the Court directed the parties to advise whether they opposed the Receiver's request. (ECF No. 46.) On July 29, 2026, Plaintiff Federal National Mortgage Association (Plaintiff) filed a letter supporting the Receiver's request, arguing that the Receiver requires counsel to address Defendants' alleged noncompliance with the Court's Order Appointing Receiver. (ECF No. 47.) That same day, Defendants Shea Markowitz and Chanan Markowitz filed a letter opposing the Receiver's request and cross-requesting a pre-motion conference on a proposed motion to stay enforcement of the Order Appointing Receiver pending resolution of the parties' dispute concerning Plaintiff's attorney's fees. (ECF No. 48.) Defendants MKBH Management LLC and Mendel Bronner subsequently joined in Defendants Shea Markowitz and Chanan Markowitz's submission. (ECF No. 49.) In light of the parties' submissions, the teleconference currently scheduled for October 1, 2026, is ADVANCED to August 5, 2026, at 1:00 p.m. During the teleconference, the Court will address the Receiver's request to retain counsel, Defendants' request to stay enforcement of the Order Appointing Receiver, and the parties' dispute concerning Plaintiff's attorney's fees. Plaintiff is directed to submit, by August 3, 2026, a letter identifying: (1) the documents, records, funds, and other information the Receiver has requested pursuant to the Order Appointing Receiver; (2) the materials Defendants have produced to date; and (3) any materials Plaintiff contends remain outstanding. The Clerk of Court is respectfully directed to terminate the motions at ECF Nos. 45, 48-49.
