("Sapphire") and Defendant/ Cross-Claim Defendant Modern Perfumes LLC ("Modern"), by and through their undersigned counsel, that the cross-claims asserted by Sapphire and Fragrancenet against Modern in the above-captioned action are voluntarily and finally dismissed with prejudice, with each party to bear its own costs and attorneys' fees.
