ORDER by Magistrate Judge Susan Prose on 07/29/2026. This matter is before the court on the parties' Unopposed Motion to Extend Deadlines (ECF No. 105 ). In light of the discovery-related motions pending before the court (ECF Nos. 72 and 95 ), the parties' 105 Motion to Extend Deadlines is GRANTED in part. The current deadlines are VACATED, to be reset at a later date. Within 14 days of a resolution on the pending motions, the parties shall submit a joint Status Report apprising the court of their proposed timeline for any remaining discovery and dispositive motions. ORDER by Magistrate Judge Susan Prose on 07/29/2026. This matter is before the court on Plaintiff's 95 Renewed Motion for Order to Show Cause Why Jacqueline Cummings-Tolliver Should Not be Held in Contempt. As of this date, Ms. Cummings-Tolliver has not responded. The court notes, however, that the Certificate of Service included with the 95 motion indicates service to Ms. Cummings-Tolliver, the subject of the motion, would be completed via certified mail, but fails to provide any details as to any address(es) to which the motion was mailed or to confirm the motion was in fact delivered. While the court agrees that Ms. Cummings-Tolliver must provide Plaintiffs and the court with an explanation for her non-appearance for the November 27, 2025 Deposition, it must first understand whether (and when) Ms. Cummings-Tolliver received notice of the instant motion.
Accordingly, Plaintiffs are ORDERED to supplement their 95 Motion with information showing whether the certified mailing indicated in the motion was successfully delivered to Ms. Cummings-Tolliver. The court reserves ruling on the Motion for Order to Show Cause, until such time as Plaintiffs provide confirmation that Ms. Cummings-Tolliver received the motion and was given an opportunity to respond.
