TEXT ORDER: Plaintiff's Motion to Consolidate (ECF No. 5), filed in Case No. 1:26-cv-07884-CPO-SAK, is DENIED without prejudice for the reasons stated on the record on August 24, 2026. The proposed stipulation to consolidate the related cases, Case Nos. 1:26-cv-01191-CPO-SAK and 1:26-cv-05668-CPO-SAK, is likewise DENIED without prejudice.Counsel shall either properly seek an extension of time to amend the pleadings in the original action, Case No. 1:26-cv-01191-CPO-SAK, or, to the extent counsel continues to seek consolidation of any of the three pending actions, file a future motion to consolidate that addresses the issues discussed at the August 24, 2026 conference, including but not limited to: the failure to file an amended pleading in conformity with the scheduling order entered in the first action; the reason for the delay in filing the second and third actions; the status of service of the pleadings and discovery in all three actions; and how consolidation would affect discovery in the first action, which is currently scheduled to close on September 30, 2026. Any future motion shall also address all other factors relevant under Federal Rule of Civil Procedure 42. So Ordered by Judge Christine P. O'Hearn on 8/24/2026. (hem, )
