   MINUTE ORDER IN CHAMBERS by Magistrate Judge Douglas F. McCormick: Order Directing a Further Bond Hearing. IT IS ORDERED that: 1. Within ten (10) days of the date of this Order, Respondents shall provide Petitioner with a new individualized bond hearing before an Immigration Judge pursuant to 8 U.S.C. § 1226(a), at which the Government shall bear the burden of establishing that Petitioners continued detention is justified by flight risk or danger to the community. 2. No later than forty-eight (48) hours before the hearing, Respondents shall provide written notice of the date, time, and manner of appearance to Petitioner and to Petitioners habeas counsel of record. 3. If Respondents fail to provide Petitioner with a hearing satisfying paragraphs 1 and 2 above, Respondents shall release Petitioner from custody under appropriate conditions of supervision. 4. No later than three (3) days after the hearing, the parties shall file a joint status report apprising the Court of its outcome.Petitioners request for immediate release (Dkt. 10) and Respondents request for dismissal of the Petition with prejudice (Dkt. 11) are DENIED (nbo)
