MINUTE entry before the Honorable Virginia M. Kendall. The briefing schedule laid out on 6/11/26 at 1466 is updated as outlined in enclosed attachment and Defendants' Motion to reconsider the schedule 1478 is granted in part. The substantive analysis laid out therein has not changed. In its discretion and after oral argument, however, the Court has determined that tweaking the remedy in accordance with Defendants' proposal honors the spirit of that ruling as well as efficient case management principles, while simultaneously ensuring the parties can build a robust record. See Pfeil v. Rogers, 757 F.2d 850, 85758 (7th Cir. 1985) (briefing schedules serve "the purpose of properly framing the issues in allowing the moving party to respond to all of the resisting party's arguments in its reply brief as well as allowing the trial court to organize and control its calendar in an orderly manner"); see also Kyles v. J.K. Guardian Sec. Servs., 236 F.R.D. 400, 402 (N.D. Ill. 2006) ("Underinclusive and skeletal presentations impermissibly shift the responsibility to the court to do the lawyer's work and to explicate the arguments that the briefs have left undeveloped."); United States v. Dunkel, 927 F.2d 955, 956 (7th Cir. 1991) ("Judges are not like pigs, hunting for truffles buried in briefs."). The "careful balancing act" demanded by class certification and complex litigation generally underscores this determination. Arandell Corp. v. Xcel Energy Inc., 149 F.4th 883, 893 (7th Cir. 2025).
