Plaintiff Tina Puls provided notice that she intended to amend her complaint as a matter of course in lieu of responding to the motions or defending her operative complaint. (Notice of Election, ECF No. 25.) She then filed a fourth amended complaint. (4AC, ECF No. 31.). The Court invited the parties to file written objections to "Plaintiff's assertion that she may amend her complaint as a matter of course." (Order Re: Notice of Election 1, ECF No. 26.) Compu-Link and HUD submitted responses presenting legal arguments and affirmative requests for relief but no such objections. (CompuLink Resp., ECF No. 28; HUD Resp., ECF No. 27.) Plaintiff submitted a response to the responses. (Pl. 's Resp., ECF No. 32.) The Court disregards these uninvited filings. Given Plaintiffs submission of an amended complaint, the Court denies the motions to dismiss the prior version of the complaint as moot.Defendants shall respond to the fourth amended complaint within the time prescribed by Federal Rule of Civil Procedure 15(a)(3).
