Case called. Court had colloquy with counsel. As no approval was sought on the time and expense record keeping protocol and no reports were provided, by or before 10/7/2026, Plaintiff shall file a proposed protocol similar to the one issued in 1:23-cv-12059-IT Document 58 .
In re to 82 MOTION for Settlement Plaintiff's Motion for Final Approval of Class Action Settlement, the Court will approve the overall settlement in the sum of $3,500,000. Those who requested exclusion will be excluded. The administrator's fee, and service awards of $1,500 to be awarded. The only question remaining are the fees and expenses, which will be reviewed by the Court and a final determination will be made.
In re to the enhancement of security going forward, Defense counsel shall confer with his client to determine if there is an objection to the enhancements being reviewed by the Court in camera.
