Order on Motion for Extension of Time Order on Motion for Extension of Time of Discovery Cutoff Deadline
PAPERLESS ORDER. THIS CAUSE came before the Court upon Defendant's Unopposed Motion for Extension of Deadlines. 34 . Therein, Defendant explains that a dispute arose during the Rule 35 Medical Examination of Plaintiff that occurred on June 4, 2026, which is the subject of a discovery dispute pending before Magistrate Judge Marty Fulgueira Elfenbein, and that Defendant's Rule 26(a)(2) expert disclosures "necessarily depend upon the completion of a meaningful medical examination," which at earliest would take place in September should the Court order a second examination to occur. Id. at 2; see also (ECF Nos. 35, 36). Defendant also argues that that this potential medical examination "is critical to evaluating Plaintiff's claimed damages, assessing the extent to which any alleged injuries may be attributable to pre-existing conditions, completing expert discovery, and allowing the parties to engage in meaningful mediation with a complete understanding of the medical issues in dispute." Id. at 3. As such, Defendant requests extensions of the Rule 26(a)(2) expert disclosure deadline, discovery deadline, as well as mediation and pretrial motion deadlines, while keeping the existing trial period. Id. at 3. Plaintiff does not oppose the relief requested. Id. at 3. Accordingly, UPON CONSIDERATION of the Motion, the pertinent portions of the record, and being otherwise fully advised in the premises, it is hereby ORDERED AND ADJUDGED that the Motion 34 is GRANTED. The Rule 26(a)(2) expert disclosure deadline shall be September 30, 2026. The deadline for all discovery, including expert discovery, shall be October 20, 2026. The deadline for both mediation and all pretrial motions as specified in (ECF No. 16) shall be November 9, 2026. No other deadlines imposed in (ECF No. 16) as amended by (ECF No. 33) are affected by this Order. Signed by Judge K. Michael Moore on 8/3/2026. (ss01)
