The parties shall meet and confer to discuss the timing of a settlement conference with the Court or a private mediator and to propose new case management deadlines. The parties shall submit a Joint Motion to Amend the Fourth Amended Scheduling Order 464 on or before September 25, 2026, noting any dates on which the parties disagree and, by the same deadline, shall jointly email the Court at Elkins_Chambers@mnd.uscourts.gov regarding whether a settlement conference with a private mediator or the Court is preferred and the timing of the conference or mediation.
Additionally, Plaintiffs have indicated that they would like to request filing an early motion for summary judgment and may file a letter brief of no more than three pages to District Judge Katherine M. Menendez by September 25, 2026, explaining why the Court should hear an early motion for summary judgment. Defendants may file a letter brief of no more than three pages in response to Plaintiffs request on or before October 9, 2026.
