ORDER: Appellant's motions to recuse [19, 22] are DENIED. To the extent that appellant's motion for clarification 25 is a request for recusal, it is similarly DENIED. Appellant's motion for reconsideration 17 is construed as a motion for leave to amend their opening brief and is GRANTED; the Court ORDERS the parties to move forward with the briefing schedule described herein. Appellant's motion for extension of time to reply to appellees' briefs 24 is therefore DENIED as moot. To the extent that appellant's motion for clarification 25 is a request for extension of time, it is GRANTED. Appellant's amended opening brief is due by 8/26/2026. Appellees' amended opposition brief, or notice to the Court that they will not be amending their brief, is due by 9/9/2026. Appellant's reply brief is due 9/23/2026. 1 - Scheduling
SCHEDULING ORDER. Appellant does not make a specific extension request in her Motion for Extension of Time, ECF 6 , but states that she "does not know when the count begins to calculate 30 days" and that she "will need as much time as is legally possible[.]" The Court GRANTS appellant's Motion as follows: Pursuant to the Bankruptcy Appeal Scheduling Order, ECF 4 , appellant shall serve and file appellant's brief within thirty days of the docketing of the transmittal of the record. The transmittal of the record was entered on July 6, 2026, ECF 3 , with transmittal of additional documents on July 9, 2026, ECF 5 . Construing the transmittal of additional documents in appellant's favor, appellant had until August 8, 2026, to file her brief. In light of appellant's motion for extension of time, the Court EXTENDS appellant's deadline to file her brief from August 8 to August 28, 2026. Upon mailing of this Order to appellant, the Clerk shall include a copy of the Bankruptcy Appeal Scheduling Order, ECF 4 , entered in this case.
