FOURTH AMENDED CIVIL CASE MANAGEMENT PLAN AND SCHEDULING ORDER:By May 12, 2026, the parties shall complete any third-party discovery regarding class certification. By September 18, 2026, Plaintiffs shall file their class certification motion and serve any supporting expert report(s). By October 30, 2026, all fact depositions to the extent relevant to class certification must be completed (without prejudice to noticing new deponents or re-deposing any deponent in the course of merits discovery). The depositions taken during this period shall be limited only to class certification issues. By December 18, 2026, Defendants shall file their opposition to Plaintiffs' class certification motion and serve any supporting expert report(s). By January 29, 2027, all class certification expert depositions shall be completed. By March 1, 2027, Plaintiffs shall file their reply in further support of class certification and serve any supporting expert report(s). Motions due by 9/18/2026. Responses due by 12/18/2026 Replies due by 3/1/2027. Deposition due by 1/29/2027. All parties do not consent to a trial before a Magistrate Judge at this time. The case is to be tried to a jury.
