Minute Entry for proceedings held before Judge Silvia L. Carreno-Coll: Motion Hearing held on 09/30/2026. Present on behalf of Plaintiffs were Attorney Giancarlo Font-Garcia, Attorney Miguel A. Nazario-Briceno and Attorney Francisco E. Colon-Ramirez. Present on behalf of Defendant NFEnergia were Attorney Jose Ramon Rivera-Morales, Attorney Alberto J. Castaner-Padro, Attorney Christopher R. Hart and Thomas N. Lightsey III, Attorney Maria A. Dominguez-Victoriano, Attorney Juan J. Casillas-Ayala and Attorney Victor O. Acevedo-Hernandez. Attorneys Hart and Lightsey appeared by VTC. Present on behalf of the United States Coast Guard (USCG) were AUSA Dennise N. Longo-Quinones and SAUSA Cody A. McKinney. AUSA Longo-Quinones informed that neither the U.S. Attorney for the District of Puerto Rico nor the Captain of the Port were served the subpoenas that were issued. Because of that, the Captain of the Port was not present in Court. Nevertheless, and bearing in mind the applicable Touhy regulations, she proceeded by proffer with the USCGs position regarding the pending matters. The Court then took a brief recess. Court proceedings resumed and the Court heard the parties' positions regarding the pending matters. Then, Atty. Dominguez asked the Court for a brief recess to engage in discussions with the Plaintiffs with the goal of entering a stipulation that would address the present controversy. The parties also requested an in-Chambers meeting. The same was held and the parties were then dismissed to discuss a possible stipulation. The parties were instructed to return in the afternoon to inform the Court of their progress. Once proceedings resumed, Atty. Dominguez informed the Court that, albeit having exchanged drafts, the parties had reached an impasse. Atty. Colon explained why the Plaintiffs disagreed with the language proposed by Defendant NFEnergia. The Court attempted to mediate the matter. The parties appeared to agree with the Court's suggestions and were dismissed to continue working on a stipulation. The Court instructed the parties to file a motion once a resolution was reached. The Court noted that the matter regarding the sanctions that were imposed on Defendant NFEnergia and Captain Daniel Montes will be addressed separately. (Court Reporter Joe Reynosa.)
