   Order on Motion to Stay Discovery

   ORDER granting the 19 Motion to Stay Discovery, filed by Defendants Sid J. Gautreaux, Warden Fontenot, Lt. Collins, Major McFarland, Capt. Miles, Capt. Leader, Sgt. Garment, Cpl. Alexander, Cpl. Chatman, Deputy Dunn and Deputy Sawyer for good cause shown. Plaintiffs Monica Lafayette, individually and on behalf of the Estate of Maressa Mays and on behalf of minor child Tari Mays, and Marvin Hamilton, Sr., individually and on behalf of the Estate of Maressa Mays, were given until September 2, 2026 to advise whether they intended to oppose the Motion. R. Doc. 20. As Plaintiffs did not timely respond, the Motion to Stay Discovery is considered unopposed. Additionally, "[t]he Supreme Court has now made clear that a plaintiff asserting constitutional claims against an officer claiming [qualified immunity] must survive the motion to dismiss without any discovery," Carswell v. Camp, 54 F.4th 307, 2022 WL 17335977, *3 (5th Cir. 2022). Carswell also ruled out discovery on other claims before adjudication of qualified immunity, because individuals asserting qualified immunity are to be free from the burden of discovery, including participation in discovery directed to other parties. Carswell, id. at *5, citing Ashcroft v. Iqbal, 556 U.S. 662, 685-86 (2009). Because these defendants have asserted a qualified immunity defense in their pending 16 Motion to Dismiss, and considering the Fifth Circuits holding Carswell, all discovery in this case is STAYED until the Court rules on the 16 Motion to Dismiss. The parties shall jointly move to lift the stay of discovery within 14 days of the ruling on the Motion to Dismiss if all claims are not resolved at that time.
