Order on Motion to Compel
Magistrate Judge M. Page Kelley: ELECTRONIC ORDER entered. In light of the court's order in the related case United States ex rel. Nunnelley v. Regeneron Inc., 20-cv-11401-PBS, ECF. No. 486 (D. Mass. Oct. 13, 2026), Regeneron's Motion to Compel 1 is allowed in part and denied in part. Regeneron may seek industry practice information from no more than ten of the manufacturers it has already served with subpoenas and may not serve any more manufacturers. Regeneron and the manufacturers it selects should meet and confer no later than October 27, 2026, to negotiate the least intrusive means of answering the narrow question: Did the manufacturer include credit card fee reimbursements in the ASP calculations for its buy and bill drugs between January 1, 2015, and March 28, 2024? The manufacturers are not obligated to provide Regeneron with reasonable assumption memoranda, internal pricing documents, or communications with the government. Regeneron and the manufacturers it selects shall also devise a cost sharing scheme. (Woo, Owen)
