MEMORANDUM OPINION AND ORDER re: 95 MOTION to Stay Pending Interlocutory Appeal. filed by Ogilvy Group, LLC, Portland PR, Inc., Ogilvy Public Relations Worldwide LLC, 93 MOTION for Leave to Appeal Certify Interlocutory Appeal filed by Ogilvy Group, LLC, Portland PR, Inc., Ogilvy Public Relations Worldwide LLC. For the foregoing reasons, Defendants' motion to certify the Order for interlocutory appeal pursuant to Section 1292(b) is GRANTED. The motion for a stay pending resolution of any such interlocutory appeal is GRANTED in part and DENIED in part. The parties are ORDERED to meet and confer with respect to both the scope and timing of what discovery is to proceed pending the resolution of the interlocutory appeal and, no later than two weeks from the date of this Opinion and Order, file a joint letter with respect to these issues. Defendants are ORDERED (with their consent, see Defs.' 1292(b) Mem. 3) to seek expedited review and briefing before the Second Circuit. Finally, the parties are ORDERED to file a joint letter notifying the Court when the interlocutory appeal is resolved and proposing next steps.
